The process includes submitting a labor certification application to the DOL's Employment and Training Administration (ETA). Once this certification is obtained, the employer submits an immigration petition to Citizenship and Immigration Services (CIS). Additionally, the employer must prove the following:

  • There are no qualified U.S. workers suitable for the position at the prevailing wage.
  • The employer is able to pay the prevailing wage for the position.
  • Employing the foreign worker will not have a negative impact on the wages and working conditions of U.S. workers in similar positions.
